These terms govern the use of the vomini.com website and its content. Please read them carefully: by browsing the site or using the contact channels published on it, you agree to what is written here.

1. Who we are

The vomini.com website is owned and operated by Vomini LTDA, a Brazilian company registered under CNPJ 60.583.661/0001-19, with its head office at Avenida Paulista, 1106, São Paulo, SP, Brazil ("Vomini"). Vomini is a software and artificial intelligence consultancy that builds custom systems and its own products for companies.

2. What these terms cover

These terms deal only with the use of the site: its pages, text, images, videos, demonstrations and contact channels.

Engaging Vomini for consulting, development or any of its products is governed by the contract or by the terms of that product or service, as signed or accepted by the client. If these terms and a contract signed with Vomini differ, the contract prevails.

If you do not agree with these terms, do not use the site.

3. What the site offers

The site presents Vomini, its services and its products, and offers ways to reach the team: a contact form, e-mail, phone, SMS and meeting booking. There are no user accounts, no restricted area and no payments on vomini.com.

The site is aimed at companies and professionals and is for use by people aged 18 or over.

4. Information, demonstrations and prices

The content of the site is for information. Vomini takes care to keep it correct and up to date, but product descriptions, examples, videos, demonstrations and results mentioned are illustrations of what the systems do. They are not a promise of results for any specific case, and real performance depends on the conditions of each project.

What the site presents is not a commercial offer. The scope, deadlines, price, service levels and guarantees of each piece of work are those set out in the written proposal and in the contract signed with the client. The delivery guarantee described on the site is part of Vomini's projects and applies on the conditions written in each contract.

Product prices shown on the site are those in force on the date they appear and may change. Existing customers remain on the conditions of their own contract.

Nothing on the site is legal, accounting, financial or regulatory advice.

5. Intellectual property

The site and everything on it, including text, visual identity, trademarks, logos, images, videos, animations, code and the arrangement of the content, belong to Vomini or to those who licensed them to Vomini, and are protected by Brazilian copyright, software and industrial property law (Laws No. 9,610/1998, No. 9,609/1998 and No. 9,279/1996) and by the applicable international treaties.

You may view the site, share links to its pages and quote short passages with attribution. Any other use, such as copying, reproducing, modifying, distributing or commercially exploiting the content, requires Vomini's prior written permission.

Vomini, Omivia and Vomini Volta, as well as the names of the other products presented on the site and their logos, are distinctive signs of Vomini. Using the site gives you no licence or right over them.

If you send us suggestions or comments about the site or the products, Vomini may use them freely, with no obligation to pay. This does not apply to confidential information exchanged under a contract or confidentiality agreement.

6. Acceptable use

When using the site, you agree not to:

  • break the law or infringe the rights of others;
  • try to access systems, data or areas that are not public, or test or exploit vulnerabilities without Vomini's written permission;
  • interfere with the operation of the site, overload it or introduce malicious code;
  • use bots, scrapers or other automated means to copy the content in bulk or to train artificial intelligence models, except for indexing by search engines that respect the robots.txt file;
  • send false information, unsolicited advertising, unlawful content or other people's personal data without a legal basis through the form or the contact channels;
  • impersonate another person or company;
  • remove authorship or trademark notices.

Vomini may block access by anyone who breaks these rules.

If you find a security flaw, report it to contact@vomini.com before disclosing it.

7. Third-party links and content

The site links to third-party services, such as Calendly and LinkedIn, and plays videos hosted on YouTube, which are loaded only when you press play. These services have their own terms and privacy policies, and your use of them is between you and each of them. Vomini does not control these services and is not responsible for their content or availability.

8. Communications

8.1 How we contact you

When you get in touch through the form, by e-mail, phone or SMS, Vomini replies through the same channel or the contact details you gave, to deal with your request. If you give a phone number on the form, we may call it. We send SMS only under the conditions in section 8.3.

Vomini does not record calls without telling you at the start of the call.

You can ask at any time to stop receiving commercial contact. Just reply to the message with that request or write to contact@vomini.com.

8.2 E-mail

Vomini's commercial e-mails identify the sender, carry the company's address and explain how to stop receiving them.

8.3 SMS programme for our United States number

Vomini serves people outside Brazil on +1 775 305 8815, by call and by SMS. The conditions below apply to text messages exchanged through it.

  • Programme: Vomini SMS, service messages between the Vomini team and people who contacted the company. The subjects are answers to questions, arranging meeting times and following up on proposals and projects.
  • How you opt in: you start receiving messages when you send an SMS to this number or when you ask, in writing or by voice, to be answered by SMS. Vomini does not send SMS to anyone who has not done one of these two things.
  • Frequency: message frequency varies with the conversation.
  • Cost: Vomini does not charge for messages. Message and data rates may apply, according to your carrier plan.
  • How to opt out: reply STOP to any message. From then on you receive no more SMS from this number unless you text us again.
  • Help: reply HELP, write to contact@vomini.com or call +1 775 305 8815.
  • Consent: agreeing to receive SMS is not a condition of buying any product or service.
  • Delivery: carriers are not liable for delayed or undelivered messages, and delivery depends on your carrier's coverage and service.
  • Privacy: mobile numbers and SMS consent data are not sold or shared with third parties or affiliates for marketing purposes. How this data is handled is described in the Privacy Policy.

9. Availability of the site

Vomini works to keep the site up and running, but it may be unavailable because of maintenance, technical failure or events outside Vomini's control. Vomini may change, suspend or close any part of the site at any time.

10. Liability

The site is free and its content is offered as general information. To the extent the law allows:

  • Vomini does not guarantee that the site will work without interruption or error, or that the content suits a specific purpose of yours;
  • Vomini is not liable for decisions made on the basis of the site's content alone, without a proposal or contract;
  • Vomini is not liable for indirect damage, loss of profit or loss of data arising from the use of the site or the inability to use it, or for the acts of third parties, including the third-party services linked to the site.

These limits do not apply to damage caused by Vomini's wilful misconduct or gross negligence, and do not remove any liability that the law does not allow to be excluded or limited. Nothing in these terms reduces the rights that Brazil's Consumer Protection Code (Law No. 8,078/1990) or the law of the country where you live gives to consumers.

Vomini's liability for contracted services and products is as defined in the relevant contract.

11. Privacy

The handling of personal data by the site and the contact channels is described in the Privacy Policy, which forms part of these terms.

12. Governing law and jurisdiction

These terms are governed by the laws of the Federative Republic of Brazil, including the Internet Civil Framework (Law No. 12,965/2014) and the General Data Protection Law (Law No. 13,709/2018).

The courts of the City of São Paulo, State of São Paulo, Brazil, are chosen to settle any matter relating to these terms. This choice does not apply against consumers, who may bring proceedings in the courts of their place of residence and keep the protection of the mandatory rules of the country where they live.

13. Changes

Vomini may change these terms. The version in force is the one published on this page, with the date at the top, and applies to use of the site from that date.

14. General provisions

If a clause of these terms is found invalid, the others remain in force. The fact that Vomini does not enforce a clause at a given time does not mean it waives it.

These terms are published in Portuguese, English and Spanish. If the versions differ, the Portuguese text prevails.
